Submerged Lands Lease Applications

Contacts for a Local Resolution

To obtain a Submerged Lands Lease or Permit, an applicant must first obtain a resolution or ordinance from the local authority stating that the submerged lands in question are not necessary for:
 

"...the construction, maintenance, or operation by the municipal corporation, county, or port authority of breakwaters, piers, docks, wharves, bulkheads, connecting ways, water terminal facilities, and improvements, and marginal highways in aid of navigation and water commerce and that the land uses specified in the application comply with regulation of permissible land use under a waterfront plan of the local authority." (See ORC 1506.11 (B)).

For each application, the local authority is the appropriate municipality, port authority or county that has jurisdiction over the site where the project is located. (See list below) Without a resolution or ordinance from the local authority, the state can not issue a Submerged Lands Lease or Permit.

Fifty percent of the annual funds collected for the leasing of Lake Erie submerged lands are returned to the local authority that has jurisdiction over the site where the project is located. (See FY 2008 revenue and returns)

A sample letter requesting a resolution from a local authority is below. Additional instructions are provided in the Coastal Permits and Lease Booklet regarding a submerged lands lease.

 

When requesting a resolution, remember to:

  • Include the tax map parcel ID, street address, and a location map for the parcel upland of the project.

  • Include a copy of the construction drawings.

  • Provide instructions on where to send the resolution.

  • Allow sufficient time in your planning for the local office to process your request.

 

 Sample Letter:

Dear [ insert local authority name]:

I have applied to both the U.S. Army Corps of Engineers and the Ohio Department of Natural Resources to place a structure (drawing enclosed) on the submerged lands of Lake Erie adjacent to my property (tax parcel ID #: [ insert tax parcel ID # here]). 

One of the necessary components for obtaining a lease from the State of Ohio is an ordinance or resolution from the local authority stating that the area of submerged lands in question is not needed by the local authority for future improvements (i.e. breakwaters, harbors, marinas, piers, etc.) and that the land uses in my application comply with regulation of permissible land use of the local authority.

Please consider and act on my request for this resolution or ordinance at your next possible meeting. I greatly appreciate your assistance, and have provided my address and phone number for your convenience.
